Questions to Ask Before You Sign a Builder Contract in Huntsville

by Donalta Hall

Before you sign a new construction contract in Huntsville or Madison, ask about your deposit, what is included in the price, what happens if the build runs late, whether you can bring your own inspector, and how the warranty works. Builder contracts are written by the builder's attorneys to protect the builder. The questions below help protect you.

Is my earnest money refundable?

Ask how much the deposit is, when it is due, and in what situations you could get it back. Some builders hold deposits as nonrefundable once a lot is reserved or once upgrades are ordered. Know the answer before money changes hands, and get it in writing.

What exactly is included in the base price?

The model home is usually loaded with upgrades. Ask for the standard features list for your plan and compare it to what you saw. Flooring, cabinets, countertops, lighting, landscaping, fencing and window blinds are common places where the base home and the model home differ.

Is there a lot premium?

Some lots cost more because of size, location, views or privacy. Ask if your lot has a premium, how much it is, and why. A lot premium is part of your price, so it should be part of your comparison.

What happens if the build is delayed?

Ask for the estimated completion date and what the contract says if that date moves. Weather, materials and inspections can all cause delays. If you are timing a lease end or a move, this matters. Ask how you will be updated and whether any of your incentives expire if closing slips.

Can the price change after I sign?

Ask whether the contract price is locked or whether there is any clause that allows increases. Also ask how change orders are priced if you want to add something later. Surprises after signing are hard to undo.

Are my incentives tied to conditions?

Many builder incentives depend on using the builder's preferred lender, closing by a certain date, or choosing from a list of homes. Make sure every incentive amount and every condition is written into your contract. If you want to understand which incentive is worth the most, read what builder incentives are really worth.

Can I bring my own home inspector?

Yes, you should ask for this even on a brand new home. City inspections check for code, not for quality. Many buyers schedule a private inspection before drywall goes up and again before closing. Ask the builder when inspections are allowed and put it in writing.

How does the warranty work?

Ask for a copy of the warranty before you sign. Many builders offer a short workmanship warranty, a longer warranty on major systems, and a longer structural warranty. Ask how to submit a claim, who handles repairs, and how long they take to respond.

Who is on my side during the contract?

The sales rep in the model home represents the builder. I represent you. I review the contract with you before you sign, help you ask the right questions, compare incentives side by side, and stay with you through the design center, inspections and final walkthrough.

Bring your agent on your first visit to a community, since many builders require your agent to be registered at that visit. To learn more, join our monthly new construction webinar or book a builder consultation.

Frequently asked questions

Can I negotiate a builder contract in Huntsville?

Some terms can be negotiated, like incentives, upgrades or closing costs, especially on homes that are finished or close to finished. The base contract language is usually harder to change, which is why it helps to understand it before you sign.

Do I need a home inspection on new construction?

It is a smart idea. City inspections check code. A private inspector looks at quality and can catch items before drywall and before closing, when they are easier to fix.

What should I get in writing from the builder?

Your price, lot premium, included features, upgrades, incentives and their conditions, deposit terms, estimated completion date and warranty.

Does the builder's sales agent represent me?

No. The builder's sales agent works for the builder. A buyer's agent works for you.
